Partner Host Cancellations Policy
This policy applies to the Host Agreement governing Bookings of Properties on the Platform, which may be adjusted by Luxico at any point in time, and assumes the capitalised definitions from the Partner Host Agreement.
1. Cancellations are unfortunate, and once a Booking has been confirmed on the Platform, it cannot legally be cancelled, however, extenuating and extraordinary circumstances arise and require a process guiding parties if such an unfortunate event occurs.
2. The Guest Booking Terms address where a cancellation occurs by a Guest, and pursuant to the Partner Host Agreement, the Host agrees to comply with the same, including the return of Rent or other Fees to comply. You agree to such Fees being charged to any credit card held by us, and if not available, you agree to prompt payment of the same within thirty (30) days of an accurate invoice from us for the same.
3. Once a Guest's Booking has been confirmed, you are not permitted to cancel that Booking other than in extenuating and extraordinary circumstances that mean it is impossible for you to satisfy the Booking on the required dates or to the standard required in the Partner Host Agreement. If this is the case, you must notify us immediately and provide such evidence as we need to verify the situation and comply with the Guest Booking Terms.
4. A Partner Host will be held responsible for a cancellation if the Listing's conditions significantly differ from its description at the time of booking. Examples include double-booking, substituting a different property, or major inaccuracies that disrupt a guest's stay, such as advertising a feature like garage access, or a gym, when this feature cannot be made available to guests, or furniture that is of a significantly different standard than what appears in the Listing.
5. If the Partner Host is responsible for a cancellation of a Booking, in part or after it has been confirmed for extenuating and extraordinary circumstances, you will be responsible for all Fees plus at least a cancellation fee to the equivalent of 25% of the Rent ("Cancellation Fee"), except where:
a. An Instant Booking is cancelled within 24 hours from Booking Confirmation, in which case no cancellation fee will apply; or
b. The Property Owner has sold the property and the Partner Host has provided written notice of the sale of the property, in which case no cancellation fee will apply and the property will be immediately delisted from the platform.
6. In addition to a Cancellation Fee, and notwithstanding any fees or consequences being waived, other consequences may apply, such as suspension or cancellation of the Listing on the Platform indefinitely, until all appropriate arrangements have been made with affected parties, in our absolute discretion.
